## 1. Seller

1. The online store wpAsist.eu (the “Store”) is run by Przemysław Szczęch, trading as wpAsist.eu, ul. Juliusza Słowackiego 17j, 36-040 Boguchwała, Poland (the “Seller”).
2. The Seller runs a non-registered business activity within the meaning of Art. 5(1) of the Polish Entrepreneurs’ Law of 6 March 2018. For this reason the Seller has no entry in the Polish business register (CEIDG) and no tax identification number (NIP).
3. Contact: e-mail help@wpasist.eu, phone +48 667 548 210.

## 2. Definitions

1. **Buyer** – a natural person, legal person or organisational unit placing an order in the Store.
2. **Consumer** – a Buyer who is a natural person making a purchase not directly related to their business or profession.
3. **Plugin** – software for WordPress / WooCommerce offered in the Store.
4. **Licence** – a licence key that entitles the Buyer to updates, technical support and the Plugin features that require an active licence, for the number of sites and the period stated in the offer.
5. **Trial** – free 3-day access to the full functionality of a Plugin.
6. **Custom Service** – development of a feature, modification or plugin based on an individual quote.

## 3. Plugins and licences

1. Plugin code is released under the GNU GPL v2 or later. The Licence purchased in the Store covers the licence key, updates and technical support.
2. A Licence is valid for 12 months from the date of purchase, unless the offer states otherwise, and covers the number of sites stated in the offer.
3. After the Licence period ends, the Buyer may renew it. Licences do not renew automatically unless the Buyer chooses this option at checkout.
4. Without an active Licence, some Plugin features may stop working. The scope of these limitations is described in each Plugin’s documentation.
5. Technical support is provided by e-mail on business days. The Seller usually replies within 48 hours.
6. Minimum technical requirements (PHP, WordPress and WooCommerce versions) are listed on each Plugin’s page.

## 4. Free trial

1. Every Plugin can be tested free of charge for 3 days, with no obligation and no payment details required.
2. After 3 days, features that require a Licence stop working. If the Buyer does not want to buy a Licence, they simply uninstall the Plugin, at no cost.
3. The Trial is available once per Plugin for one Buyer or one domain.

## 5. Orders and payments

1. Prices in the Store are final prices. The Seller is exempt from Polish VAT under Art. 113(1) of the Polish VAT Act, so no VAT is added to the prices.
2. At the Buyer’s request, the Seller issues a receipt or an invoice without VAT (marked as VAT-exempt).
3. The contract is concluded when the Buyer receives the order confirmation e-mail.
4. The Buyer receives the licence key and the Plugin download link by e-mail immediately after the payment is received.
5. Available payment methods are shown at checkout.

## 6. Right to a refund

1. Every Buyer, whether a Consumer or a business, may request a full refund within 30 days of purchasing a Licence, without giving a reason. Details are set out in the Refund Policy.
2. This 30-day period includes and extends the Consumer’s statutory 14-day right of withdrawal.

## 7. Custom Services

1. The scope, price and deadline of a Custom Service are agreed individually in a quote sent by e-mail. Payment is due only after the Buyer accepts the quote.
2. A Consumer may withdraw from a Custom Service contract within 14 days of concluding it. If, at the Consumer’s express request, work began before this period ended, the Consumer pays for the part completed up to the withdrawal. Once the Service has been fully performed, the right of withdrawal expires; the Consumer is informed of this before work begins.
3. The 30-day Refund Policy applies to Plugin Licences, not to Custom Services.

## 8. Complaints

1. Complaints can be sent by e-mail to help@wpasist.eu. Please include a description of the problem, the site address and the order number.
2. The Seller responds to complaints within 14 days.
3. Plugins are supplied as digital content. Towards Consumers, the Seller is liable for the conformity of digital content with the contract under applicable consumer law.
4. Consumers may use out-of-court dispute resolution, e.g. the consumer protection authorities in their country or the European Consumer Centres Network (ECC-Net).

## 9. Liability

1. The Seller takes care to make Plugins work correctly and securely. The Buyer should back up their site before installing any Plugin.
2. Towards Buyers who are not Consumers, the Seller’s liability is limited to the amount paid for the Licence concerned. This limitation does not apply to damage caused intentionally.

## 10. Personal data

The processing of personal data is described in the Privacy Policy available in the Store.

## 11. Final provisions

1. These Terms are governed by Polish law. This choice of law does not deprive Consumers of the protection granted by the mandatory provisions of the country of their habitual residence.
2. The Seller may change these Terms for important reasons, such as changes in the law. Changes do not affect orders placed before they take effect.
3. If these Terms are published in several languages, the Polish version prevails in case of discrepancies, unless mandatory consumer law provides otherwise.
